Extent of Services and Liabilities.
MediShenzhen is a platform operated on our behalf by Retail Sale Solutions Ltd. ("RSS"). Medishenzhen.com is a platform that provides Chinese medical and health appointment services for eligible users. MediShenzhen not licensed or registered to provide medical/healthcare services. Any agreements or relationships with MediShenzhen.com do not constitute a doctor-patient/traditional Chinese medicine practitioner patient relationship/healthcare professional patient relationship, and the doctor-patient/traditional Chinese medicine practitioner patient/healthcare professional patient relationship only exists between doctors/traditional Chinese medicine practitioners/healthcare professionals on MediShenzhen.com and patients (within the scope established by doctors/traditional Chinese medicine practitioners/healthcare professionals). MediShenzhen.com does not assume any responsibilities as a professional medical/health care institution, and does not provide medical or health care services. They also do not offer any medical or health care opinions, suggestions, or consultations, nor do they prescribe medication or provide other medical, health care, or clinical services. Any of the above activities during the process of doctors/traditional Chinese medicine practitioners/health care professionals providing services through MediShenzhen.com are exclusively carried out by doctors/traditional Chinese medicine practitioners/health care professionals and our medical partner contractors. MediShenzhen.com does not assume or share the responsibilities or liabilities of doctors/Chinese medicine practitioners/healthcare professionals regarding the quality or appropriateness of the medical or healthcare services they provide, including the manner in which medical or healthcare services are provided (such as through video consultation), and such services are solely based on the independent exercise of professional judgment by the relevant doctors/Chinese medicine practitioners/healthcare professionals.
Use of the Platform
Your use of MediShenzhen.com and the services provided under it shall be at your own risk. MidiShenzhen.com is not intended to replace the routine in-person meetings between doctors/TCM practitioners/healthcare professionals and patients in any way. Any information, advice, opinions, diagnoses, treatments, services, medical certificates, and medications provided by doctors/TCM practitioners/healthcare professionals are provided by and on behalf of the specific doctor/TCM practitioner/healthcare professional, and are solely based on the doctor/TCM practitioner/healthcare professional exercising their professional judgment.
Endorsement Liabilities.
MediShenzhen.com is provided to promote the connection between users and medical institutions. MediShenzhen.com (i) does not recommend or endorse any specific doctors/traditional Chinese medicine practitioners/healthcare professionals; And (ii) to the maximum extent permitted by applicable laws, for any reason, we will not be responsible or liable for any information, advice, opinions, diagnosis, treatment, services, medical certificates and/or drugs provided or given by such doctors/Chinese medicine practitioners/healthcare professionals as booked using the MediShenzhen.com platform, nor will we recognize, support or recommend them.
Endorsement Liabilities.
To the maximum extent permitted by applicable law, if any of your prescription drugs or medical certificates are used or misused, or if anyone is authorized to use, take, and/or administer your prescription drugs or medical certificates (whether or not you agree or are aware), MediShenzen.com and Retail Sale Solutions Ltd shall not be responsible or liable in any way.
Registration and Service Use
You must register as a user of the MediShenzhen.com application in order to access the service.
Registration must take place either using this platform or by downloading a registration document from this platform and submitting it back to us for review.
During the registration process you will be required to provide certain information, including but not limited to a valid email address (alias email addresses are not accepted) and a valid mobile phone number (the phone number must be able to receive and send text messages, and you should be aware that your mobile service provider may charge you for using text messages), and you will need to create a password before registering on MediShenzhen.com. Valid Emergency contact details must be provided. MediShenzhen.com reserves the right to validate all contact information by any means practical at any time.
If the user is a minor under the age of 18, any registration on MediShenzhen.com must be approved by the minor user's parents/legal guardians, who will also be the emergency contact person for the minor user and the person representing the minor user to agree to MediShenzhen.com's terms and conditions.
All information registered in the system will be stored securely on our Database Servers, which are housed only in Tier 1 Global Data Centers applicable to your country of Residence. We adhere strictly to the GDPR Regulations regarding the use and storage of personal information. Any information transmitted through our systems to Medical Service providers will not be retained by us once we have received a confirmed receipt from the recipient
Content and Communication Guarantee
By entering into an agreement with MediShenzhen.com (Retail Sale Solutions Ltd) you undertake not to infringe or assist in infringing any other party's intellectual property rights (including but not limited to copyright, patent, trademark, and database rights); Or violate any legal obligations to third parties, including but not limited to contractual obligations and confidentiality obligations
In particular, you agree, declare, and warrant that you have the right to submit user content, and that when submitting user content (or using the MediShenzhen.com application to communicate in any other way), you shall not submit, communicate, or otherwise engage in any pornographic, obscene, intentionally offensive, hateful, or other behavior that incites or promotes violence, promotes or assists any form of illegal activity, discrimination, defames in any way any person, group, or category of person, race, gender, religion, nationality, disability, sexual orientation, age, political orientation, or membership in a "trade" organization; Intending or potentially threatening, harassing, angering, warning, causing inconvenience, discomfort, or embarrassment to others in any other way; Intentionally or possibly deceiving others in other ways; Intending or potentially infringing (or threatening to infringe) on the privacy of others in any other way, misleading anyone by intentionally deceiving, or distorting your identity or affiliation in any other way
Payment , Insurance and Contract Agreement Start.
Any contract will not take effect until Payment has been received in full for the contracted services. If you are booking Travel and Accommodation, Extensions, or other services through MediShenzhen.com, payment for these services must be made in full before the contract is accepted, unless otherwise agreed in writing. Payments to Medical Service Providers are made directly under contract with them, not through this platform.
Payment, using our Secure Processing system, can be made using Credit or Debit Card, PayPal, or Bank Transfer. Subject to acceptance, Third Party credit facilities, subject to status, may be available on request.
You will be required to demonstrate that you have adequate travel insurance for all aspects of the trip. Prior to travel, you must upload a copy of your Travel Insurance covering the entire trip.
If you are using Medical Insurance as full or part payment of any services provided, Full details and authorizations must be presented before travel. Failure to do this may result in the forfiture of any monies paid and the cancellation of all services.
Passports and Visas
You are responsible for ensuring you have Valid travel documents, including a Full Passport with at least 6 months remaining validity from the Date of travel, plus any Visa certificates or documents that may be required for you to travel to China. If you are traveling under a Visa Waiver scheme, it is your responsibility to ensure the Scheme will remain valid for the length of your stay.
MediShenzhen.com and Retail Sale Solutions Ltd can bear no responsibility for any Travel Documentation or Visa problems at any time. If you are unable to travel on a booked excursion, we reserve the right to forfeit all fees for the said trip if you are denied travel or entry to any country.
Rights of the Company
Without prejudice to the MediShenzhen.com terms and conditions or any other rights and compensation granted to Retail Sale Solutions Ltd trading as MediShenzhen.com (The Company) in any other circumstances, the Company has the right to do the following at any time, with or without prior notice (Without affecting your statutory rights):
Change any terms and conditions of The Company.
Cancel, suspend, amend, or change any arrangement made in the event of circumstances outside the control of the Company
In particular, without prejudice to the terms and conditions of MediShenzhen.com or any other rights and remedies granted to the Company in any other circumstances, the Company shall have the right to immediately cancel any user's registration with MediSHenzhen.com, terminate any user's MediShenzhen.com account, withdraw any gifts or privileges (in whole or in part) that the user is entitled to, and/or take any other action deemed appropriate by the Company without prior notice if:
a) You have violated any of The Company's travel terms and conditions;
b) Our company suspects that you or any person has engaged in any fraudulent, dishonest, abusive or unauthorized activities
on any part of our platform (including but not limited to the registration process), regardless of whether you agree or are
aware of such fraudulent, dishonest, abusive, or unauthorized activities;
c) You are listed as a defendant in any legal action or lawsuit alleging that our company or any of our business partners use it to
transmit defamatory information, or you are threatened with prosecution for such allegations;
d) Using for improper purposes, or transmitting and distributing uninvited promotional materials or any obscene or indecent
materials, for fraudulent, dishonest or illegal use or gain,
e) Its use constitutes an infringement of any person's rights (including but not limited to intellectual property and
confidentiality rights), or a violation or infringement of any obligations or liabilities that you are required to assume to third
parties under contract law, tort law, or other laws;
If your registration with MediShenzhen.com is canceled or your account is terminated, you may no longer be able to access its services. Any reservation made will be canceled, and any reservation fees paid will not be refunded.
Additional Guarantees
All data stored on our systems is confidential and will only be disclosed with your prior consent. (Subject to applicable laws and covenants in both your country and the People's Republic of China.
You Agree to the following:-
Only authorized to use this system and resources for personal and non-commercial purposes in accordance with the terms and conditions of MediShenzhen.com
Confirm that you are the registrant, not presenting yourself as someone else or acting as someone else's agent, unless acting as the Guardian of a minor under the age of 18 years, in which case you confirm you are acting solely on their behalf.
You guarantee only to register once on the system unless also on behalf of a minor.
You agree you will not allow any other person to sell, reproduce, copy, distribute, publish, or modify any part of the System or Process without our express prior written consent
You will not engage with or use any Spiders, bots, or crawlers to disseminate information for this system at any time
You confirm that some of MediShenzhen.com's services (including medical institution services) are contributed, provided, and/or maintained by third-party suppliers.
You agree that no express or implied statements, representations, or warranties have been made regarding any services provided or given by third-party suppliers;
You confirm your understanding that we agree, disagree, approve, or endorse any suggestions, materials, or services provided by any third-party supplier;
You confirm your understanding that we are not responsible in any way for any advice, materials, and/or services provided by any third-party supplier;
You confirm your understanding that we do not guarantee the service performance of any third-party suppliers for which we are responsible.
You confirm your understanding that we hold no liability, obligation or responsibility for any direct or indirect loss, expense or damage (including but not limited to consequential loss, loss of profit or damage) arising from or in connection with the use, inability to use, misuse or reliance on any advice, materials or services provided by any third-party supplier, or any loss, expense or damage that the user or any other party or person may suffer or incur as a result of or in connection with any advice, materials or services provided by any third-party supplier; We do not assume any responsibility for any loss or damage arising from the use of third-party services, and users shall bear the relevant risks on their own.
You confirm your understanding that we do not assume any responsibility, obligation, or liability for any loss, damage, property damage, personal injury, or death caused by or related to the medical consulting services provided by third-party suppliers to users.
Personal Information
When registering and accessing services with MediShenzhen.com, you may be required to provide certain personal information to our company. You have certain rights regarding the personal information you provide. MediShenzhen.com will make its utmost commercial efforts and caution to safeguard your personal information. You must agree to the "Personal Data Collection Statement" and "Medical Travel Privacy Statement" as shown during the application process in order to complete registration and utilize these services
